The previous article in this series describes what your attorney should do for you in the event of a personal injury (PI). This article discusses how to handle a lawyer who does not do what he should do.
It always amazed me how some UI attorneys are sitting on the case. I think about it. PI attorneys are usually paid for a contingent fee - this means that they receive a percentage of what they can get for you. Why, then, did your lawyer let your case sit idle? Of course, the overhead of a lawyer does not sit idle.
The answer neatly falls into two categories: your attorney is too busy, or he is too lazy. While the first, of course, is better than the last, and not for you.
Here are the steps you should take if you suspect your attorney is too busy or too lazy:
1. Talk to the best PI attorney in your area or find out what a real attorney will do in your case. ,
These consultations are almost always free.
How do you find a main lawyer in your area? Not on TV, not on the yellow pages. If you want, you can call me or send me an email and I will be happy to help you. The best way to send me an email is to get your value by filling out 10 questions in the Claims Calculator link below. This will give me both your email address and specific information about your case (amount of property damage, medical bills, loss of salary, etc.). I can find, through the list of lawyers' associations, a list of services and other means leading lawyers in each area of the United States. I communicate directly with a lawyer about your details of your case, and if he wants to meet with you, I will contact you with a lawyer so that you can schedule time to meet or talk about your case.
How do you know that a lawyer is one of the best in your area? Simple - he publishes his millions of results right on his website. Lawyers who help people find the best - their results speak for themselves. A lawyer who does not publish his or her results on his website is not proud of his results. You can be sure that a lawyer who repeatedly recovered over a million dollars for individual clients, knowing how to successfully process your file. Successful lawyers also have a reputation that insurance companies know about. This reputation can make a big difference when the insurance company decides whether to rely on a reasonable amount or jerk around your lazy lawyer until he convinces you to accept the calculation with a low ball.
2 Fire him or make him leave?
What happens if you hire him? It depends on the state, so consult a new lawyer you are meeting with. As a rule, lawyers are entitled to compensation for the work they did in the case until the moment you fired him. As a rule, this is determined by the number of working hours multiplied by the reasonable hourly rate (based on his experience). He must give you the file (it belongs to you). He may keep a copy of the file, but usually ethical rules require that copying be done at his expense. A lawyer can put a "lien" on the time spent on your case, which is paid only if you get a recovery with your new lawyer.
Important: If your new lawyer really wants your case (and you are asking for it), a new lawyer often pays a life lawyer lawyer from the new annual lawyer's fee. In other words, switching lawyers won't cost you anything extra. In fact, for the same annual commission that you always paid, you now have a much better lawyer who will receive even more compensation for your injuries.
What happens if he leaves? If your lawyer quits, he cannot demand a lawyer for the work he has done. If your lawyer quits, you don’t need to worry about whether your new lawyer agrees to take over the lawyer’s bail as part of his premium. And the new lawyer does not need to worry about the fight of the old lawyer with the unreasonable lawyer.
A lazy lawyer is usually tired of a client who constantly calls a lawyer who claims that the case is moving forward. Frequent calls for a lawyer usually do the trick, although he never bothers to “enter” the law office and ask to meet with a lawyer or, if he does not, his assistant. If no one is available by phone or in person, insist on a day / time to meet in person. Tell them that you want to view the entire file. When you meet (or talk on the phone), find out when a lawyer intends to file a lawsuit. The lawsuit forces the insurance company to hire a lawyer (i.e. pay the money). It also causes the deadlines the insurance company must fulfill. Without deadlines, the insurance company gladly keeps your money in the stock market - this is really how insurance companies historically built wealth. That is why insurance specialists are trained to postpone the demand in a timely manner. Repeating the requirement that your lawyer file a lawsuit, or leave the case so that you can hire a lawyer who can, you can get rid of this lazy lawyer.
